My lease has been pooled with other leases, what can I do? | The Law Offices of Gregory D. Jordan

My lease has been pooled with other leases, what can I do?

If your lease granted the oil company the right to “pool” your property with other leases, then that right must be exercised in good faith. The oil company must act in fairness and good faith as a reasonably prudent operator would under the same or similar circumstances, taking into account both your interests and its interests. Sometimes oil companies engage in bad faith pooling where there is no valid basis for pooling your tract. In such circumstances, you may be entitled to recover damages or obtain injunctive relief.
